1. Agreement to Terms

By accessing or using the Skinsign mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Skinsign. Please read them carefully.

2. Important Medical Disclaimer

• Skinsign analyzes visible skin surface conditions and tracks lifestyle patterns for informational and educational purposes only.
• The AI-generated skin scores, acne classifications, and correlation insights are not medical diagnoses.
• Skinsign is not regulated as a Software as a Medical Device (SaMD) under FDA guidelines and is not intended as such.
• Correlation insights show statistical patterns in your data, not medical causation.
• You should always consult a qualified dermatologist or healthcare provider for medical concerns about your skin.
• Do not delay seeking professional medical advice because of information provided by Skinsign.
• If you experience severe or worsening skin conditions, seek medical attention immediately.

3. Eligibility

• You must be at least 13 years old to create an account and use Skinsign.
• If you are between 13 and 17, you must have consent from a parent or legal guardian.
• Skinsign is designed for users aged 16 and older.
• By creating an account, you represent that you meet these eligibility requirements.
• We reserve the right to request proof of age and to terminate accounts that do not meet eligibility requirements.

4. Account Registration and Security

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the security of your account credentials.
• You must use only your own facial photos for skin analysis (not photos of others).
• One account per person.
• You must notify us immediately of any unauthorized use of your account.
• We are not liable for any loss resulting from unauthorized access to your account.

5. Subscription Terms

Free Tier

• Access to skin scanning (last 3 scans visible)
• Water tracking
• Education Hub (all articles)
• Limited insight previews

Premium Subscription

Free Trial

• A 7-day free trial of Premium features is available to new users.
• You will not be charged during the trial period.
• After the trial, you will be automatically subscribed to the plan you selected unless you cancel at least 24 hours before the trial ends.

Billing and Renewal

• All subscriptions are billed through the Apple App Store.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscription in your Apple ID account settings.

Refunds

• Refund requests are handled by Apple in accordance with their refund policy.
• Skinsign does not process payments or issue refunds directly.

Price Changes

• We may change subscription prices with at least 30 days notice.
• Price changes will not affect your current billing period.
• Existing subscribers may be grandfathered at their current rate at our discretion.

6. Your Data and Content

• You own all personal data and content you submit to Skinsign, including your photos, lifestyle logs, and notes.
• By using Skinsign, you grant us a limited, non-exclusive, non-transferable license to process your data solely for the purpose of providing and improving the Service.
• This license automatically terminates when you delete your account.
• You represent that you have the right to submit all content you upload.
• You must only upload photos of yourself for skin analysis.

7. AI-Generated Content Disclaimer

• Skin scores, acne classifications, and correlation insights are generated by artificial intelligence.
• AI-generated analysis may contain errors, inaccuracies, or inconsistencies.
• Confidence levels are provided as estimates and do not guarantee accuracy.
• Correlation insights identify statistical patterns in your personal data but do not establish medical causation.
• Your results may vary based on photo quality, lighting conditions, and other factors.
• AI analysis should not be relied upon as the sole basis for health or lifestyle decisions.

8. Acceptable Use

You agree NOT to:

• Upload photos of anyone other than yourself.
• Use the Service for any commercial purpose without our written consent.
• Attempt to reverse engineer, decompile, or extract the algorithms or AI models used by Skinsign.
• Circumvent rate limits, security measures, or access controls.
• Use automated tools, bots, or scrapers to access the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Use the Service for any illegal or unauthorized purpose.
• Share your account credentials with others.
• Impersonate another person or entity.
• Harass, abuse, or harm others through the Service.

9. Intellectual Property

• Skinsign and its licensors own all rights in the Service, including the app, algorithms, AI models, design, brand, and educational content.
• You own your personal data and content as described in Section 6.
• The Skinsign name, logo, and related marks are trademarks of Skinsign.
• You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our written consent.
• Educational articles and content within the app are protected by copyright.

10. Disclaimer of Warranties

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or secure.
• We do not warrant the accuracy, reliability, or completeness of any AI-generated analysis, scores, or insights.
• We do not warrant that the Service will meet your specific expectations or requirements.
• We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
• No advice or information obtained from Skinsign creates any warranty not expressly stated in these Terms.

11. Limitation of Liability

• To the maximum extent permitted by law, Skinsign shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• This includes, without limitation, damages for: health decisions or outcomes based on AI-generated insights, loss of data, loss of profits, or business interruption.
• Our total aggregate liability for all claims arising from or related to the Service shall not exceed the total amount you paid to Skinsign in the twelve (12) months preceding the event giving rise to the claim.
• If you have not made any payments, our maximum liability shall be $100.

12. Indemnification

You agree to indemnify, defend, and hold harmless Skinsign and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any third-party rights.
• Any content you submit through the Service.

13. Termination

• You may terminate your account at any time by deleting it through the app settings.
• We may suspend or terminate your account if you violate these Terms.
• We may discontinue the Service at any time with reasonable notice.
• Upon termination, your data will be deleted in accordance with our Privacy Policy.
• If you have an active subscription, you should cancel it through the Apple App Store before deleting your account.
• The following sections survive termination: Medical Disclaimer, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.

14. Governing Law and Disputes

• These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
• Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
• You agree to waive your right to participate in class action lawsuits or class-wide arbitration.
• Exception: Either party may bring claims in small claims court if they qualify.
• The arbitration shall take place in the United States, and the language shall be English.

15. Changes to These Terms

• We may update these Terms from time to time.
• Material changes will be communicated via email or in-app notification at least 30 days before they take effect.
• The "Last Updated" date at the top will be revised.
• Your continued use of the Service after being notified of changes constitutes acceptance.
• If you do not agree with updated Terms, you must stop using the Service and delete your account.

16. General Provisions

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Skinsign regarding the Service.
• Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
